AIRCRAFT OWNERS IN ARREARS: HOW COLLECTION ATTEMPTS CAN LEAD TO INCREASED COST, TIME, AND EVEN CRIMINAL CHARGES UNDER FLORIDA LAW.
This discussion will include relevant topics regarding collection of fees for fixed base operators, mechanics and other aircraft service providers that house aircraft for customers (collectively “Aircraft Service Providers”). There are two types of Aircraft Service Providers: those that have not been paid by a customer and those that will not be paid by a customer. There are numerous legal pitfalls to avoid when attempting to collect from a customer in arrears. The savvy Aircraft Service Provider will heed the old adage an ounce of prevention is worth a pound of cure and have procedures in place to increase collectability and avoid criminal sanctions. The discussion will conclude with general recommendations for the Aircraft Service Provider seeking to increase collectability and reduce collection cost and liability.
